Welcome to Czeska Strefa – a leading Provider of services in the fields of digital marketing, business mediation, outsourcing, education and translation. By accessing and placing an order with Czeska Strefa, you confirm that you are in agreement with and bound by the terms of service contained in the Terms of Use outlined below. These terms apply to the entire website and to any email or other type of communication between you and Czeska Strefa.

The descriptions of services available on the Website are provided for general informational purposes only and do not constitute binding offers. A binding agreement for the provision of services shall arise only upon written confirmation of a Purchase order or execution of a separate agreement or order between Czeska Strefa and you.

Under no circumstances shall Czeska Strefa team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if Czeska Strefa team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

Czeska Strefa will not be responsible for any outcome that may occur during the course of usage of our services. We reserve the rights to change prices and revise our policies at any moment.

These Terms of Use are a legally binding contract between you and Czeska Strefa (referred to in these Terms of Use as “Czeska Strefa”, “us”, “we” or “our”), the provider of the Czeska Strefa Website and the services displayed at the Czeska Strefa Website (which are collectively referred to in these Terms of Use as the “Czeska Strefa Service”).

You agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use the Czeska Strefa Service. If you violate any of these Terms of Use, we reserve the right to cancel the services.

Definitions and key terms

To help explain things as clearly as possible in these Terms of Use, every time any of these terms are referenced, are strictly defined as:

  • Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit Czeska Strefa and review the services.
  • Service or Services: refers to the services provided by Czeska Strefa as described in these Terms and on the Website.
  • Purchase order: A binding individual offer sent by Czeska Strefa to a Customer, based on the Customer’s inquiry and tailored to its needs and goals.
  • Website: The website czeskastrefa.pl, that facilitates the listing, sale, and delivery of the services. The website allows users to familiarize themselves with the type and scope of services offered, as well as to contact Czeska Strefa.
  • Third-party service: refers to advertisers, sponsors, promotional and marketing partners, or other subcontractors whose services are used by Czeska Strefa for the delivery of the Services.
  • Written communication/Written form: Any communication made in plain written form, as well as any communication made in an electronic environment, such as by email or through the contact form on the Website or through a chat system integrated into the Website or through an instant messaging application (e.g., Viber, WhatsApp, and others).
  • You: a person or entity that is using the Website to order the Services. Also referred to as “Client” and “Customer”.
Content Rights

All content available on this Website, including but not limited to text, images, graphics, audio, video, software, and any other material (the “Content”) is either owned by or licensed to Czeska Strefa, the respective author, or third-party rights holder. By using the Website, you acknowledge and agree that all rights, titles, and interests in and to the Content are reserved by the respective owner or rights holder, unless expressly stated otherwise. You are not granted any right, license, or interest in the Content except as explicitly permitted by these Terms or with the express consent of the owner. You may access and view the Content solely for personal or lawful business use. Any reproduction, distribution, modification, public display, performance, or other unauthorized use of the Content, without the prior written consent of the respective owner, is strictly prohibited.

Intellectual Property

The Website and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Czeska Strefa, its licensors or other providers of such material and are protected by Bulgarian, EU and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of Czeska Strefa, unless and except as is expressly provided in these Terms of Use. Any unauthorized use of the material is prohibited.

Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Website or to make it available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Website
  • Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Czeska Strefa or its affiliates, partners, suppliers or the licensors of the Website
Service Description

Czeska Strefa Website provides information about the Company’s professional services in the fields of digital marketing, business mediation, outsourcing, education and translation. Through the Website, visitors can explore detailed descriptions of each service, including their scope, purpose and the way they are delivered.

The Website also allows users to request a personalized quote by filling and submitting an inquiry through the dedicated quote form at www.czeskastrefa.com/quote or by filling out the contact form on Czeska Strefa Website. Customers can also sent inquiries through email at quote@czeskastrefa.com. Each request is reviewed individually, and a customized offer (“purchase order”) is prepared based on the Customer’s specific needs and objectives.

The services presented on the website include, but are not limited to:

  • Digital Marketing – SEO Content Analysis, SEO Translations, SEO Proofreading, Facebook and Google Ads, E-commerce consulting, Social media marketing, Graphic Design, Market research and video content creating, Advertising campaign management, content strategy and performance analytics;
  • Business Mediation – Mediating communication with customers, partners, and institutions in many different languages, establishing connections between business partners, mediating services related to the setting of virtual addresses, facilitating negotiations, dispute resolution, consecutive interpreting, and providing consulting support for building sustainable business relationships, consulting, communication and appointment arrangement related to the opening of corporate bank accounts;
  • Outsourcing – providing external professional support and tailored solutions to assist companies with customer services, sales representatives, HR support and assistance accounting and WordPress websites development;
  • Education and Training – professional courses, workshops, and personalized training programs focused on learning foreign languages, business development, digital literacy, including Microsoft Excel, financial literacy.

Czeska Strefa is not obliged to offer each of the services listed here at any given time and to each individual customer. The company reserves the right to periodically change the list of services it offers. Up-to-date information about the services offered is available on the Website.

Czeska Strefa reserves the right to offer other services beyond those described here if this is appropriate in view of the goals the customer wishes to achieve. The delivery of any service is subject to the customer’s express written confirmation and to the signing of the Purchase order.

Purchasing Process
  • Browse and Select: Users may browse the Website to view the services offered by Czeska Strefa.
  • Send an inquiry: Users can send an inquiry through the “Quote” page on the Website, through the contact form integrated on the Website or by sending an inquiry at quote@czeskastrefa.com. Upon receiving an individual offer based on the inquiry made and on the Customer’s needs, the Customer can either accept or refuse the offer by sending a confirmation in written form and by signing the Purchase order, if the offer is accepted. The Purchase order can be signed either by Qualified Electronic Signature (“QES”) or by e regular handwritten signature. Purchase Orders can also be signed with “Podpis zaufany”, if that is preferred by the Customer. The signed Purchase order must be send in a digital form or scanned to Czeska Strefa.
  • Payment: Customers pay the price of the selected service in accordance with the Purchase order provided. The price is payable within 7 days from the issuance of the invoice for individuals and within 14 for companies respectively.. Payment can be made by bank transfer to the bank account specified by Czeska Strefa or through the services of third-party payment service providers. Some of the services might be paid for in cash, depending on the nature of the services and the applicable legislation.
  • Order Confirmation: After receiving a Purchase order in written form by email or by other form of written communication, the Customer can either accept and confirm it or refuse it. The acceptance must be made in a written form and by signing the Purchase order. The Purchase order can be signed either by Qualified Electronic Signature (“QES”),by e regular handwritten signature or with “Podpis zaufany”. The signed Purchase order must be sent in a digital form, or scanned to Czeska Strefa. No delivery of services will be done before the receival of an explicit acceptance and the signed Purchase order. Any preliminary discussions or communications shall not create binding obligations.
  • Delivery: Services are provided in the specified quantity, time frame and quality based on Czeska Strefa’s internal procedures, professional competence and best knowledge and conscience. The time of delivery of the service or the period in which the service or services will be provided is stated in the Purchase order. We are not responsible for any extension of the delivery time for reasons attributable to the customer.. Following the delivery of the Services, the Customer may be invited by Czeska Strefa to provide feedback regarding the quality and performance of the Services delivered. Such feedback may be requested via email and is intended to help Czeska Strefa improve its services. The provision of feedback is entirely voluntary, and any information provided will be treated in accordance with the Czeska Stefa’s Privacy Policy.

Individual, one-time orders shall be confirmed and become binding upon the signing of a corresponding Purchase order by the Customer. For long-term or recurring engagements, a separate individual contract shall be executed in addition to the Purchase Order, setting out the specific terms and conditions applicable to such commitment. The individual contract shall prevail over the General terms of use in case of any contradictions.

Transitional Period and Interim Engagements
  1. Transitional Services. In situations where Czeska Strefa commences the provision of Services prior to the execution of a formal contract and based only on a Purchase order, including during any transition phase (“Transitional Period”), such Services shall be governed by these Terms of use and the terms set in the Purchase order.
  2. Acceptance of Terms. The Customer’s signing of a Purchase order, or acceptance of any Services during the Transitional Period, shall constitute the Customer’s full acceptance of and agreement to these Terms of use
  3. Rights and Obligations. During the Transitional Period, all rights, obligations, limitations of liability, confidentiality undertakings, and intellectual property provisions set out in these Terms of use shall apply in full, as if a formal contract had been executed.
  4. Transition to Contract. Upon execution of an individual contract between the parties, the provisions of such contract shall supersede these Terms of use to the extent of any inconsistency, without prejudice to any rights or obligations accrued during the Transitional Period.
Payment and fees. Payment Policy

All fees are payable only after delivery of the service and issuance of the invoice. By paying the agreed remuneration, the Customer confirms and accepts that the service has been delivered properly, with high quality and accurately.

Fees could be paid by bank transfer to the bank account specified by Czeska Strefa or through the services of third-party payment service providers. All fees are payable within 7 days from issuance of the invoice when due from individuals and within 14 days from issuance of the invoice due from companies, unless agreed otherwise in the Purchase order, in written communication or in an individual contract. All fees offered in a Purchase order are exclusive of applicable tax, if any.

Cancellation, Return and Refund Policy

Any objections regarding the quality of the service delivered should be made before paying the price of the service. After payment of the work, respectively its acceptance, the customer shall not be entitled to make any complaints or objections regarding the quality of the work, unless there are defects and shortcomings that the customer could not have discovered during a normal inspection of the work.

No contract will exist between you and Czeska Strefa for the Service until you accept the offer by a confirmatory e-mail, SMS/MMS message, or other appropriate written communication and by signing the Purchase order.

Compensation may only be claimed if the customer establishes a quantitative or qualitative defect in the service provided and only if this defect could not have been detected or noticed upon acceptance of the work. In this case, customers may submit a formal complaint to Czeska Strefa at the following email address – claim@czeskastrefa.com or by filing and submitting the “Dispute form” on the Website, in which they must describe in detail the service they have received and its deficiencies. Each complaint will be verified with due care and accuracy based on the data and facts found in accordance with the internal procedures of Czeska Strefa. The two parties will attempt, through negotiation and mutual understanding, to determine a fair form of compensation for the deficiencies of the work, if there are such. If mutual agreement is not reached, the customer has the right to defend their rights before the competent authorities.

If the customer is a consumer within the meaning of European legislation, pursuant to Article 57(1)(1) of the Bulgarian Consumer Protection Act, the customer confirms and agrees that by confirming the individual offer and signing the Purchase order, they give their express prior consent and confirmation that they are aware that due to the nature of the services they will lose their right to withdraw from a distance contract under the Consumer Protection Act once the Services have been fully delivered by Czeska Strefa and they are aware that the delivery of the services will begin immediately after confirming the order and within the “cooling-off” period.

If the order was made not by you and your payment credentials were used fraudulently, please contact us via email at info@czeskastrefa.com as soon as possible. We will investigate the case and will notify the competent authorities.

In no way is Czeska Strefa obligated to achieve a specific result (such as reaching a certain number of impressions, interactions, new leads, revenue, etc.), unless this is expressly agreed upon in the Purchase order and/or in an individual contract. Czeska Strefa undertakes to provide all services offered with high quality and professionalism but cannot commit to achieving specific results on the part of the Customer, as the nature of the services is such that the results depend on many factors beyond the control of Czeska Strefa. Therefore, the Customer agrees that they will not and cannot hold Czeska Strefa liable if they are not satisfied with any results or indicators after the service has been delivered.

The Customer shall provide Czeska Strefa with all necessary information, materials, and cooperation reasonably required for the proper performance of the Services. Czeska strefa shall not be liable for any delays or failures caused by the Customer’s omission or incomplete information.

Links to Other Websites & Third-Party Services

This Terms of Use applies only to the Services. The Services may contain links to other websites not operated or controlled by Czeska Strefa. We are not responsible for the content, accuracy or opinions expressed on such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Please remember that when you use a link to go from the Services to another website, our Terms of Use are no longer in effect. Your browsing and interaction on any other website, including those that have a link on our Website, is subject to that website`s own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.

We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services (“Third- Party Services”).

You acknowledge and agree that Czeska Strefa shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Czeska Strefa does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

Subcontractors

Czeska Strefa may, at its sole discretion, engage subcontractors or other third parties to perform all or part of the Services under this Terms of use, without the prior approval of the Customer. The Service Provider shall remain fully responsible for the performance of the Services, including any part thereof performed by such subcontractors, and for ensuring that all subcontractors comply with the applicable terms of this Terms of use. The use of subcontractors shall not relieve Czeska Strefa of any of its obligations or liabilities towards the Customer under this Terms of use.

Changes To Our Terms of Use

We may change our Service, and we may make changes to these Terms of Use so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through email notification) before we make changes to these Terms and give you an opportunity to review them before they go into effect. By continuing to access or use our Website after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use Czeska Strefa. If we change our Terms of Use, we will post those changes on this page, and/or update the Terms of Use modification date above.

Czeska Strefa reserves the right to modify, suspend or discontinue, temporarily or permanently, the Website or any service to which it connects, with or without notice and without liability to you. Czeska Strefa may from time to time provide enhancements or improvements to the features/ functionality of the Website, which may include patches, bug fixes, updates, upgrades and other modifications (“Updates”).

Updates may modify or delete certain features and/or functionalities of the Website. You agree that Czeska Strefa has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Website to you.

You further agree that all Updates will be (i) deemed to constitute an integral part of the Website, and (ii) subject to the terms and conditions of this Agreement.

Term and Termination

This Agreement will terminate immediately, without prior notice from Czeska Strefa, in the event that you fail to comply with any provision of this Agreement.

Termination of this Agreement will not limit any of Czeska Strefa’s rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

Copyright Infringement Notice

If you are a copyright owner or such owner`s agent and believe any material on our Website constitutes an infringement on your copyright, please contact us setting forth the following information: (a) a physical or electronic signature of the copyright owner or a person authorized to act on his behalf; (b) identification of the material that is claimed to be infringing; (c) your contact information, including your address, telephone number, and an email; (d) a statement by you that you have a good faith belief that use of the material is not authorized by the copyright owners; and (e) the a statement that the information in the notification is accurate, and, under penalty of perjury you are authorized to act on behalf of the owner.

Indemnification

You agree to indemnify and hold Czeska Strefa and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the Website; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

No Warranties

The Website is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Czeska Strefa, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, Czeska Strefa provides no warranty or undertaking, and makes no representation of any kind that the Website will meet your requirements, achieve any intended results, be compatible or work with any other software, website/apps, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Czeska Strefa nor any Czeska Strefa’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Website, (ii) that the Website will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the website/app; or (iv) that the Website, its servers, the content, or e-mails sent from or on behalf of Czeska Strefa are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.

Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of Czeska Strefa and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Services. If the amount of damage exceeds this amount, you can seek your rights before the competent authorities

To the maximum extent permitted by applicable law, in no event shall Czeska Strefa or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Website, third-party software and/or third-party hardware used with the Website, or otherwise in connection with any provision of this Agreement), even if Czeska Strefa or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

This Agreement, together with the Privacy Policy and any other legal notices published by Czeska Strefa on the Services, shall constitute the entire agreement between you and Czeska Strefa concerning the Services. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Czeska Strefa`s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. YOU AND CZESKA STREFA AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.

Entire Agreement

The Agreement constitutes the entire agreement between you and Czeska Strefa regarding your use of the Website and supersedes all prior and contemporaneous written or oral agreements between you and Czeska Strefa.

You may be subject to additional terms and conditions that apply when you order and confirm an individual order. If any of the terms and conditions herein differ from or contradict the terms and conditions in the individual offer, the latter shall apply.

Dispute Resolution

This section applies to any dispute EXCEPT IT DOESN`T INCLUDE A DISPUTE RELATING TO CLAIMS FOR INJUNCTIVE OR EQUITABLE RELIEF REGARDING THE ENFORCEMENT OR VALIDITY OF YOUR OR CZESKA STREFA`S INTELLECTUAL PROPERTY RIGHTS. The term dispute means any dispute, action, or other controversy between you and Czeska Strefa concerning the Services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. Dispute will be given the broadest possible meaning allowable under applicable law.

Notice of Dispute

In the event of a dispute, you or Czeska Strefa must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email to: claim@czeskastrefa.com. Czeska Strefa will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and Czeska Strefa will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or Czeska Strefa may refer the matter to the competent judicial authorities.

Some states/jurisdictions do not allow arbitration in relations with consumers, so the above rule may not apply to you in its entirety.

Governing Law and Arbitration

If you and Czeska Strefa don`t resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding choice of applicable law and competent court as described in this section. All disputes arising out of or relating to this Contract, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, as well as disputes concerning the filling of gaps in the Contract or its adaptation to newly arising circumstances, shall be settled by the Arbitration Court at the Association of Independent Business Experts with UIC 206591779, in accordance with its Rules and the procedures provided therein. Any and all legal, accounting, and other costs, fees, and expenses incurred by the prevailing party shall be borne by the non-prevailing party. Governing Law is the law of Bulgaria.

Some jurisdictions and laws do not allow voluntary choice of applicable law and arbitration in relations with consumers, so some of the rules in this provision may not apply to you.

Miscellaneous

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Use to be unenforceable, the remainder of these Terms of Use will continue in full force and effect. Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by an authorized representative of Czeska Strefa. Czeska Strefa will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. The Service is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access the Czeska Strefa Service from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. These Terms of Use contain the entire understanding, and supersedes all prior understandings, between you and Czeska Strefa concerning its subject matter, and cannot be changed or modified by you.

Where the Customer is a consumer under applicable law, mandatory consumer protection provisions shall apply and shall prevail over any conflicting terms of these Terms. Consumers may have specific rights to withdraw from a service contract within the statutory cooling-off period, as provided by law.
